Can I apply for a residence permit for a family member under the age of 18?
There are certain conditions that you and the child must meet in order to be entitled to a residence permit for a child.
All applicants for a residence permit have to fulfil certain requirements, but when applying for a residence permit for a child both parent and child have to fulfil specific requirements. The child must be under the age of 18, live with the parent and the child must be in the custody and support of the parent.
Thus, a parent living in Iceland must have both custody and be either the biological or the adoptive parent of the child. A guardian who is not the biological parent of the child can only obtain a residence permit for the child if they have adopted the child. Keep in mind that the adoption needs to be valid according Icelandic adoption laws
If the child's parents share custody and only one of them will be living in Iceland, the parent that does not live in Iceland needs to give their written consent stating that they approve of the child's residence in Iceland. The consent needs to be submitted with the application.
