What is checked when issuing an A1 certificate?

When assessing an application for an A1 certificate, the Social Insurance Administration considers the following points, among others:

  • Whether insurance contributions and cash payments have been made in Iceland,

  • That the employment relationship is maintained throughout the posting period. In assessing this, factors such as the employment contract, job description, and who is responsible for hiring and dismissal, et cetera., are taken into account,

  • That the employee is covered by Icelandic social security legislation at the start of the posting, so that the conditions for continuous insurance are met. An employee who is already resident or working in another EEA state at the time of hiring cannot, therefore, be covered by Icelandic legislation during the posting period,

  • That the employee was employed by the employer before the start of the posting,

  • If an employee is hired specifically with the aim of being posted to work abroad, the employer must conduct substantial business activities in Iceland. In assessing this, factors such as the registration of the business, number of employees, scope of operations, et cetera., are considered,

  • That the employee is not being sent to replace another posted employee,

  • That the applicant is an EEA citizen. An exception is made under the Nordic Convention, which also covers third-country nationals,

  • That the work is performed for the employer and at their expense within the EEA,

  • That the estimated period of employment is no longer than 24 months.
