Criteria for payment
A right may arise to payment of compensation if one of the following applies:
Applicants sustained physical or mental damage during disease treatment or examination
The applicant's spouse died due to damage during disease treatment or investigation
Parent under the age of 18 died due to loss during disease treatment or investigation
The damage must have occurred in one of the following instances:
Icelandic health care centre or hospital
Other public health institutions, wholly or partly owned by the state
In an internal ambulance transport
Health services or medical transportation abroad, as long as you are seeking necessary treatment that is not available in Iceland under the auspices of Iceland Health
The damage shall also be attributable to one of the following:
Treatment was not arranged as well as possible based on knowledge and experience
Any failure or defect of any equipment, instrument or equipment used, was observed
No alternative treatment method or technology was used and both would:
- Avoid damage from occurring
- Equivalent use to that used method
Treatment complications, for as long as:
- This occurs relatively uncommonly (less than 1-2 % of the cases)
- Is severe for the baseline disease for which treatment was to be used
- The damage is greater than reasonably tolerated without compensation by the patient
Medical experimentation that was not due to diagnosis or treatment
Transfusion of organs, tissues, blood or other body fluids by the applicant
Vaccinations against COVID-19 in 2020-2023 with vaccines from Icelandic health authorities
If all the above conditions are satisfied, the right to compensation is determined. If the amount of compensation proves to be higher than the minimum amount of compensation, the application is accepted.
