If a user undertaking purchases services from a foreign service provider, it must ensure that the foreign service provider has informed the Administration of Occupational Safety and Health (AOSH) of its operations.

In construction and civil engineering, the user undertaking must also obtain information about any subcontractors involved in the project and notify AOSH if the foreign service provider has not fulfilled its obligation to provide information.

Confirmation that the required information has been submitted

The user undertaking must request written confirmation from the foreign service provider that it has informed AOSH of its operations. The confirmation must be received within ten working days of the commencement of operations in Iceland.

If the confirmation is not received, the user undertaking must notify AOSH and provide:

• The name of the foreign service provider.

• Its address in its home country.

• The service provider’s email address.

• The name and email address of its representative.

• The type of service provided in Iceland.

If the name of the representative is not known, the name and email address of the person who represented the service provider when the service contract was concluded must be provided.

The user undertaking must provide a copy of the written confirmation to the relevant trade union representative upon request. If there is no trade union representative at the workplace, a copy must be provided to the relevant trade union upon request.

If a breach is suspected

If a user undertaking becomes aware that a foreign service provider with which it has entered into a service contract is in breach of the law, for example in relation to the pay or other terms and conditions of employment of its employees, the user undertaking must notify the AOSH without undue delay.

Information on subcontractors

In construction and civil engineering, more than one undertaking may be involved in the same project as main contractors and subcontractors. This applies, for example, to the construction, repair, alteration and demolition of structures.

If a service provider engages another undertaking to carry out part of the work, it must provide the original user undertaking with information confirming that all undertakings involved in the project have fulfilled their statutory obligations towards AOSH.

This applies to all subcontractors involved in the project, whether they carry out all or only part of the work.
