If one spouse is resident abroad and the other is in Iceland, the spouse resident abroad must request the legal separation or divorce and the other spouse must approve the claim.

Icelandic citizens resident abroad may apply for legal separation or divorce in Iceland if they agree on that arrangement. However, they first need the approval of the Ministry of Justice as to which office of the District Commissioner they should seek.

Spouses who have obtained a legal separation permit in Iceland may obtain divorce following legal separation from the District Commissioner, even though they are resident abroad, if they agree to do so.
