Divorce following legal seperation

Request for a divorce

If the spouses agree to request divorce, they may obtain it at least six months after the legal separation was granted.

If the spouses agree to request divorce on the same terms as were decided upon in the case of legal separation, the petition for divorce can be completed and filed with the District Commissioner. The divorce licence must be paid for. If both spouses complete the petition and payment was made, a licence for divorce is issued. If only one spouse has signed the petition, the spouse is invited to be interviewed by the District Commissioner. If the spouse agrees to the petition, a licence is issued for divorce when payment for the divorce licence has been made.

If a spouse wishes to make changes to the terms of separation which were decided upon when the separation was effected, they must attend the interview and explain the changes. An interview is held by the District Commissioner.

If the spouse does not appear for an interview with the District Commissioner or does not approve the request, one spouse may apply to the courts with a claim for divorce one year after the granting of the separation.

Issuing a licence for divorce costs ISK 6,500.
