Spouses with children under the age of 18 in the home must negotiate:

  • their custody

  • where they are legally domiciled

  • their financial support

The main principle when spouses divorce is the joint custody of the children, although it may be decided that full custody will be left either of the parents.

It is necessary to determine where to the legal domicile of the children shall be following divorce.

Parents are obliged to ensure that the rights of the child/children to support is guaranteed.

If the parents have a dispute regarding the custody or legal domicile of the child , the matter is referred to a mediator.

If the parents are unable to resolve the dispute over custody and/or legal domicile in mediation, they must make a claim to the courts to resolve the dispute.

A divorce or legal separation permit may not be issued unless an agreement is reached on the children's custody and domicile or confirmation has been given that legal proceedings have been brought in connection with the dispute.

Spouses are not obliged to determine arrangements regarding access before a divorce or legal separation permit is granted. In an interview with the District Commissioner regarding divorce legal separation, information on the access of children is given, and one or both spouses may request that the District Commissioner handle a case regarding access in parallel with the divorce or legal separation proceedings.
