Ruling on special contribution

Request for a ruling on special contribution (Only in Icelandic)

If payments are disputed, the parent which the child resides with may apply to the District Commissioner for a ruling on whether the other parent is obliged to pay a special contribution.

The request is then presented with the other parent and the District Commissioner shall rule on the case from the evidence provided.

If the request is approved, the parent may send the ruling to the Social Insurance Administration, which is responsible for mediating payments. The collection agency of the municipalities shall then collect the contribution from the other parent.

Claim period

Claims must be submitted within three months of the date of receipt of expenditure. Exceptions are:

  • In connection with the confirmation of a child, a claim must be submitted within three months of the date of the confirmation, but the preparation receipts may be older.

  • In the case of orthodontic treatment, it may be reasonable to wait until the end of treatment for a claim for such actions, i.e. when the teeth or the braces are removed from the teeth. The claim must then be submitted within three months of that date.

Supporting documents with the application

  • The last two tax returns of the claimant. An electronic copy is available on your site on www.skattur.is.

  • Information on current year income; cash register, pay slips, payment slips or other.

  • Certificate of custody

  • The current decision on child/children maintenance, e.g. a divorce licence, a confirmed agreement on child maintenance, a ruling, a judgment or a court settlement on child maintenance. The document may already be available from the District Commissioner.

  • Accounts/receipts for cost of the special expenses.

  • Other data as appropriate.

If the application is because of the confirmation or baptism of a child:
  • Confirmed document that the confirmation/baptism took place.

If the application is because of the orthodontic treatment of a child:
  • Summary of Icelandic Health Insurance showing payment participation. The right to payment processing application must be submitted with the right to access checklist, otherwise an e-mail may be sent to and information on the consent to payment participation obtained.

  • An orthodontist's statement on the progress of treatment and when the bars, braces or other items were applied and removed.

If the application is because of the disease of a child:
  • Medical certificate

Complaint period

A ruling by a District Commissioner may be appealed to the Ministry of Justice. The deadline for appeals is 2 months.
