Children's domicile and its effects

Legal domicile of the child in a split residence

  • When parents have made an agreement on the split residence of a child, the child shall be considered to have permanent residence with both of them. Parents shall jointly make all decisions about the child, irrespective of registration at the legal domicile.

  • The parents may not request child maintenance or a special contribution from the other parent. The parents shall have an agreement on the maintenance of the child/children.

  • Child benefits are paid to both parents based on family status at the end of the year. (To be implemented in 2023)

  • If the agreement on split residence is cancelled, the child remains domiciled with the parent with whom he/she was registered as domiciled before the agreement was implemented.
