After an agreement is made on shared residence, a child resides with both of his or her parents. The National Registry will record legal domicile with one parent and residence with the other. The parents are both obliged to support their child, but arrange the support according to their agreement. When a contract on shared residence of a child takes effect, a contract, ruling, court settlement or judgment on access and support shall lapse. A request for a ruling on access, per diem fines, child support, foreign travel for a child cannot be submitted to the District Commissioner while the agreement on shared residence is in effect. Parents who have agreed on shared residence of a child cannot request that the District Commissioner confirm an agreement on visitation, special expenses or child support.
Parents who have agreed on shared residence of a child make joint decisions regarding the child. While a shared residence agreement is in effect, neither parent has more right than the other to make decisive decisions regarding the daily life of the child.
Child benefit and interest benefit
When parents have agreed upon shared residence of a child, child benefit for each parent shall be determined in accordance with family status at the end of the year and the age of the child, and shall be limited to half of the calculated child benefit, after taking into account the income reduction for each. When parents have agreed upon shared residence, their interest payments and interest payments are determined, as is the case with single parents.
