A shared residence of a child is a contract between parents with joint custody that the child has permanent residence with both of them. The National Registry will record the child as having been domiciled with one parent and registering a residence home with the other. A contract on shared residence is made with the District Commissioner; a court settlement may also be made on a division of residence. A contract on shared residence may be made for a period of at least six months.
The Act which allows shared residence took effect on 1 January 2022. The aim of this Act is to promote reconciliation and a more equal position for parents who exercise joint custody of a child and decide to raise it together in two homes. A contract on shared residence shall always take into account the best interests and needs of the child.
If parents are unsure whether a shared residence is in the best interests of their child, attention is drawn to the advice given by the local authorities, which is specifically intended for parents who do not live together and is called Samvinna eftir skilnað . Parents may also contact the District Commissioner and request guidance and information on shared residence.
