Residence right of family members of EEA/EFTA citizens

• Spouse (marital or cohabiting spouse).

• Descendants, i.e. children or grandchildren of the EEA/EFTA citizen or his/her spouse, who are under the age of 21 or are their dependants.

• Dependent direct relatives in the ascending line and those of the spouse (parents/grandparents).

• Parent or guardian, if the EEA/EFTA citizens is under 18 years of age.

Family members of students
Only spouses and decendants under the age of 21 have the right to reside in Iceland as family members of EEA/EFTA citizens who reside in Iceland as students.

EEA/EFTA citizens are citizens of Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Netherlands, Norway, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden and Switzerland.

Icelandic citizens are not considered EEA/EFTA citizens in this context, except in cases where they have resided in another EEA/EFTA country and have recently moved back to Iceland.

The close relative of an Icelandic citizen can therefore only apply for a residence card as a relative of an EEA/EFTA citizen in Iceland if:

• the Icelandic citizen has lived in another EEA/EFTA country with a right of residence for at least three months. The person in question has had a right of residence if they have, for example, worked, looked for work, studied or been self-sufficient during their stay in the other EEA/EFTA country.

• the Icelandic citizen and their close relative lived together in the other EEA/EFTA country immediately before moving to Iceland together.

If you are a citizen of a country outside the EEA/EFTA and want to move to Iceland to live with an Icelandic citizen who is not considered an EEA/EFTA citizen according to the above requirements, you must instead apply for a residence permit.
