Co-payers

The District Commissioner of North West Iceland is responsible for collecting the co-payments.

According to Icelandic law, a child is guaranteed a minimum of support. The person with whom a child has legal domicile has the right to child support from the other person who is obliged to pay child support. District commissioners and courts decide on the obligation to pay child support. The Social Insurance Administration may prepay the child support to the beneficiary on a special request and the District Commissioner collects it from the other person obliged to pay child support. It should be noted that parents can take the route of paying child support directly without the involvement of the Social Insurance Administration. Child support payments are often omitted when the amount of care is equal and the costs for the children are equally divided between parents, as is common practice today. Child support payments are not linked to social security payments and the amount of child support is the same as the amount of the child pension from the Social Insurance Administration.

The amount of the co-payment from 1 January 2024 is ISK 46,147 per month.

New co-payers

The person who pays the costs of the child's or children's maintenance may demand child maintenance from the other parent. The person concerned must take custody of the child and the child must be domiciled with that parent. Child maintenance can be confirmed either by agreement between parents at the District Commissioner's office, by a ruling of the District Commissioner or by a court decision. Following such a decision or agreement, the parent who has a claim for payments may turn to the Social Insurance Administration and receive the child maintenance in advance. When the Social Insurance Administration has started paying child maintenance to its beneficiary, the District Commissioner takes charge of the collection. A special letter is sent to that effect, specifying the liability as well as the amount of the child maintenance that is due monthly.

The recipient of a child's allowance may apply for it a year back.

Collection process

When a claim is created, it appears in the debtor's home bank. If the claim is not paid within 30 days and the claim is not negotiated, the following measures are available to prompt payments:

  • Request sent to employer

  • Debt balance

  • Funding

  • Forced sales

  • Registration in the default register
