Legal basis for processing personal data

The authorisation of the processing of personal data by the National Electoral Commission is based on point 3 of Article 9 of the Data Protection Act, No. 90/2018, which states that the processing of personal data is permitted if it is necessary in order to fulfil a legal obligation on the controller.

Personal data is considered information on an identified or identifiable individual, or the information can be traced directly or indirectly to a specific individual.

Processing of personal data by the National Election Board

The National Electoral Board only processes personal data that is necessary and needed for the purpose for which it is intended.

The National Election Board processes various personal data, such as name, ID number, domicile, postal address, email address and telephone number.

The National Electoral Board does not collect or store sensitive personal data.

The Data Protection Statement of the National Election Board does not cover information or processing by third parties.

The National Election Board shall preserve the personal data of staff and candidates for positions with the National Election Board.

Individuals have the right to information on whether the National Electoral Board is working with their personal data. The rights of individuals are discussed in Chapter III of the Act on the Protection of Privacy as regards the Processing of Personal Data.

The National Election Board is a party required to submit documents pursuant to the Public Archives Act and is therefore prohibited from deleting documents without the express consent of the National Archives of Iceland.

Security of personal data

The National Election Board shall manage the confidentiality of personal data it holds in accordance with the Act on the Protection of Privacy as regards the Processing of Personal Data and the Act on the Rights and Obligations of Government Employees, cf. Section X of the Administrative Procedures Act.

The National Election Board places great emphasis on the fact that all processing of personal data is secure and in conformity with the provisions of the Act on the Protection of Privacy as regards the Processing of Personal Data.

The National Electoral Board does not make use of personal data it obtains or obtains irresponsibly, untrustworthily or illegally.

Supervisory body
