International protection, rights and application procedure
Application processing
Applications for international protection are not all processed in the same way. Some applications are processed under an accelerated procedure and result in a refusal, while others result in a decision to transfer the applicant to another State under the Asylum and Migration Management Regulation (AMMR). Only some applications are examined on their merits to determine whether the applicant qualifies for international protection.
Which procedure applies to your application depends on several factors, including your nationality and your links to other countries.
Accelerated Procedure
If you are a national of a safe country of origin where you can obtain protection from the authorities, your application for international protection will normally be processed under an accelerated procedure. A decision may be issued within a few days. If your application is refused, you will be required to leave Iceland.
AMMR cooperation
If you stayed in another European country before travelling to Iceland, you may be required to return to that country without your application for international protection being examined on its merits in Iceland. This is because Iceland participates in the Asylum and Migration Management Regulation, which determines which participating State is responsible for examining an application for international protection.
Substantive procedure
If none of the above applies to you, your application will be examined on its merits. Only applications examined under this procedure are assessed to determine whether the applicant qualifies for refugee status, subsidiary protection, or a residence permit on humanitarian grounds.
