Child support upon divorce or separation
With spouses, the custody of children and registration of legal domicile must be determined. At the same time, parents may agree on child support payments.
If an agreement is reached, the District Commissioner shall issue a divorce licence or confirmation of a contract in connection with cohabitation and send a notification of a change of domicile to the National Registry. In the absence of a domicile amendment, the same party must inform the amendment itself to the National Registry at a later date.
If there is a dispute regarding the payment of child support, the parent which has the legal domicile of the child can apply for a ruling on child support payments to the District Commissioner. A ruling is sent to both parents. The appeal period is generally 2 months.
Child support upon contract of custody or domicile.
Parents may enter into agreements between them to change the custody or domicile of the child. When a contract is made, parents can at the same time make an agreement on child support.
Child support upon child birth
If a child is born outside the cohabitation or marriage, parents can make a child support agreement.
In disputed cases a request can be sent to the District Commissioner for a resolution. First , though , an acknowledgment of fatherhood must be made.
If it is not possible to father a child or if a child was conceived with the help of assisted reproduction techniques, an application can be made from TR instead of child support.
