Both the au pair and the host family may terminate the au pair placement agreement. The termination must be in writing and takes effect as soon as it has been demonstrably served on the other party. A copy of the termination notice must be sent to the Directorate of Immigration.
Termination of the agreement is permitted due to general disagreement. If a host family wishes to terminate the agreement, they must give the au pair 30 days' notice to leave the placement. If an au pair wishes to terminate the agreement, they must give the host family 15 days' notice.
Termination of the agreement is permitted with immediate effect in the following cases:
If serious circumstances concerning the host family or the au pair necessitate it, for example illness.
Due to serious misconduct by either the host family or the au pair, such as a breach of Icelandic law or the provisions of the au pair placement agreement. In cases of doubt, the Directorate of Immigration will assess whether termination is permitted on the grounds of serious misconduct.
Misconduct may be deemed to have occurred when the parties to the contract are in material breach of the terms of the au pair placement agreement, for example, by exploiting the au pair's labour or if the au pair commits misconduct at work or fails to perform their duties.
An au pair can enter into a new agreement with another host family. Such a contract shall be submitted to the Directorate of Immigration along with documents on secure means of support from the new host family.
