End of service

When individuals have received a final refusal

A foreign national who has had his/her application for international protection finally rejected shall be entitled to services until he/she has left the country, but for a maximum of 30 days from the time the decision became final at the administrative level. At the end of this period, the licence shall expire, with the exception of acute health care.

The rights of children, parents or their supervisors and other members of the household who are considered relatives of children, pregnant women, seriously ill persons and persons with long-term support needs, may not, however, be waived.

When the applicant is a national of an EEA/EFTA State or comes from a state that is in the process of being assessed as obviously unsuitable, the right to service is cancelled when the Directorate of Immigration has rejected an application for international protection.

Deferment of cancellation of rights

The police may defer the cancellation of rights, if this is deemed necessary for reasons of fairness and if the foreign national has shown a willingness to cooperate in the implementation of the decision to leave the country. This does not apply, however, to nationals of EEA/EFTA states and states on the Immigration and Asylum Appeals list and the application for the applicant has been clearly found to be unsuitable.

In assessing whether the cancellation of rights should be postponed, the police shall consider, among other things, whether the foreign national has not managed to leave the country voluntarily within the specified time limit due to circumstances which are not his/her responsibility, such as the impossibility of obtaining travel documents, his/her disability or due to uncontrollable external circumstances.

The Directorate of Labour may decide to postpone the withdrawal of services to individuals who have applied .

When individuals withdraw their application for protection

Service shall cease three days after the applicant for international protection has withdrawn his/her application.

When individuals are granted protection, additional protection or humanitarian authorisation

Services shall cease to be provided no later than eight weeks after the publication of the decision to grant protection to an individual or three days after another place of residence is offered by a public entity to an individual who has been granted protection.

The Directorate of Labour may decide that the suspension of service to an individual who has approved another premises under the auspices of a public body shall be postponed.
