Information on returning a sold residential property to Þórkatla

The property company Þórkatla would like to submit the following information to Grindvíkingar.

It is important to note that although the law on the purchase of property in Grindavík by the Icelandic Property Association Þórkötlu is based on the prevailing uncertainty about the future of the community, the company is working on the basis that in the future there will be a prosperous community. The company is focused on taking over the property of Grindvíkingar in a satisfactory condition and will, as circumstances allow, seek to rent or sell the property to Grindvíkingar again in the future. Therefore, the company makes the same general requirements for returning the property as in any other real estate transaction.

Information on returning a sold residential property to Þórkötlu.

The accompanying furniture must comply with the provisions of the Housing Acquisition Act no. 40/2002. Accompanying furniture for residential housing is permanent furnishings and/or equipment that is permanently fixed to the property or specifically tailored to it according to Article 24 of the Act.

The law does not contain a requirement that the premises be painted before delivery.

The instructions from the real estate agent and the provisions of the purchase agreement on the capital allowance are included.

However, the board of Þórkötlu has decided that the seller may, at his expense, remove electric charging stations intended for charging cars, if this is done according to the legal procedures for the electrical system of real estate.

Provisions of the purchase agreement on included items

If no other agreement is made, the asset shall have the equipment and rights specified in Articles 22 - 24 of Act No. 40/2002 and were in place on 10 November 2023, (or later) and/or be followed according to the purchase agreement, other documents or custom, cf. the following list, as appropriate.

  • The kitchen must have a stove, oven and fans.

  • The bathroom comes with a fixed hanger, fittings and appliances as well as a cupboard over or at the sink.

  • Mud and nail-fast stands and shelves in storage are included.

  • Fixed lights and chandeliers must be in the kitchen, bathroom and separate laundry room and at least one lampstand in each room.

  • The property shall be accompanied by all wall and nail-mounted fittings, mirror tiles, curtain bars and fittings, but not curtains, with the exception of rim, strip and roll curtains.

  • In the garage, there is a fixed lighting system, electric door openers, as well as fixed shelves and closets.

  • In the garden, there are permanent storage garages, saunas, hot pots and platforms.

  • The seller may, at his expense, remove electric charging stations intended for charging cars, if this is done according to the legal procedures for the electrical system of real estate.

Summary of included items

According to a list from the Association of Real Estate Agents, as no other agreement has been reached between the parties.

  • Ice cabinet, fridge, dishwasher, microwave: Special refrigerators, fridges, dishwashers or microwaves are not included unless specifically mentioned in the sales statement. If a kitchen appliance is included in part of the overall layout of the kitchen, it is generally an accessory, i.e. when a fixed door to be unlocked is located in front of the integrated kitchen appliance.

  • Bathroom fixtures: Mirrors and shelves that are attached to a wall and are considered part of an interior fixture are accessories of real estate, unless otherwise specified. All other items that are attached to a wall such as a towel oven and bathing fixtures are accessories.

  • Wardrobes: Fixed wardrobe is considered as ancillary property, as it is clearly part of the furnishings of the property. Furnishings in wardrobe, such as shelves, bars and the like are ancillary. Loose wardrobe in rooms is not included, unless mentioned in the sales statement.

  • Wardrobes/bathrooms in a living room or a public space: Even though such items are attached to a wall, they are not considered as accessories.

  • Lights: Fixed lights and chandeliers shall be in the kitchen, bathroom and separate laundry room and at least one lampstand in each room. All embedded lights in the ceiling, outdoor lights and garden lighting shall be considered as accessories.

  • Carpets: Fixed flooring comes with.

  • The fireplace: The fireplace, electrical generator and fireplace are included, regardless of how they are mounted.

  • Smart House Solutions: Comprehensive solutions for real estate light control and the like.

  • Television and accessories: Airnet is considered as ancillary. Additionally, other connections that are necessary to be available for television and internet.

  • Gardens: Rims, strips, rollers, and darkening curtains are considered as accessories. Gardens are not considered as accessories, but curtain rods must be included.

  • Car garage: Electric door opener, fixed cabinets and shelves are considered accessories.

  • Other things outside the building: a flagpole and other items that have been fixed down such as a hot tub, toys, the outdoor patio and a marker ice cream are all considered as property accessories.

  • Trees, plants, gardens: Considered as accessories.
