Amendments to the Act on Foreigners’ Right to Work
20th March 2023
On 15 March, amendments to Act on Foreigners’ Right to Work No. 97/2002 were approved.
The amendments included changes to the provisions, 11, 12 and 22 of the Act, which implies that holders of residence permits on humanitarian grounds and on grounds of special ties to the country will subsequently be exempted from the requirement for a temporary work permit. In addition, holders of such residence permits will also be entitled to payments of unemployment insurance, with other conditions being fulfilled.
This group includes refugees from Ukraine who have been issued a residence permit on the basis of Article 44 of Act No. 80/2016 on Foreigners due to mass emigration. Information on the type of a residence permit is provided on the residence permit card of the individual.
The Directorate of Labour will stop processing the applications for work permits for these two groups, which have already been submitted to the Directorate for processing, and send notifications to applicants that the processing has been stopped as a foreigner is now exempt from the requirement for a temporary work permit, as per Article 22 of the Act.
