Dispute over change of custody
Custody may be changed by agreement with the District Commissioner or by a court. A contract or a request for a change in custody shall be submitted to the District Commissioner in the jurisdiction where the child is domiciled.
If parents disagree on a change in custody of a child, each parent may submit a request for a change in custody to the District Commissioner. If no agreement can be reached on a change in custody, the District Commissioner shall refer the matter to a mediation procedure directed by the mediator.
If conciliation is unsuccessful, a certificate of conciliation is issued, but both parents may apply to the courts for a legal action to be taken against him/her within 6 months of the issue of the certificate of conciliation.
If an agreement is reached or conciliation procedure is successful, the District Commissioner shall issue confirmation of the change of custody, if he deems it to be in the best interests of the child, and shall notify the amendment to the National Registry of Iceland.
