The rights of air passengers in the event of airline bankruptcy depend on who provided the service, which service was purchased and where it was purchased.

If a flight is cancelled due to bankruptcy, you can:

  • to apply for a refund to the credit card company, if the ticket was paid with a credit card. Information about reversals within the EU/EEA can be found here.

  • declare a claim in the company’s bankruptcy estate, inter alia, under Regulation (EC) No 261/2004 on the rights of air passengers.

Strikes

Passengers who experience difficulties due to strike action are entitled to information and services as other passengers, for example:

  • meal and refreshments according to the length of the delay

  • phone call

  • accommodation if needed

  • trip to a place to stay

Strikes by third parties, such as airport staff, air traffic controllers or ramp operators, are considered to be circumstances of force majeure. Strikes by airline staff are not considered to be circumstances of force majeure.
