Permission to sit in an undivided estate
How the inheritance is divided between the surviving spouse and other heirs
If the surviving spouse is alive, he/she owns half of the joint estate.
The other half belongs to the deceased and is divided so that the spouse receives 1/3 and 2/3, divided among the children of the deceased or those who take their place in the inheritance. These proportions may differ if the deceased has decided in his will.
If the estate is divided after the death of both spouses, the right of inheritance of the spouse who is more long-term heir shall lapse.
If one spouse has no heirs, the heirs of the other spouse shall thereafter be deferred.
