Three Supreme Court sentences
4th October 2023
Today, three court rulings were made in the Supreme Court.
Firstly, a judge ruled on the right of an employee of the City of Reykjavík to accident compensation because of an accident that he suffered when he ran home from his work. The majority of the Supreme Court concluded that the employee should be compensated on the basis of the rules on accidents that employees suffer during their work, as it was believed that he had been on a normal route from his workplace to his home when he suffered the accident, as the route he ran was not excessively long and there was no interruption in his journey. Two judges gave a separate vote and believed that the accident had been settled correctly on the basis of the rules on accidents that employees suffer outside of their work, as the route that the employee chose to take had not been an essential part of his journey between his workplace and his home.
Secondly, a judgment was made in a case that had been reopened by a decision of the Court of Re-Inclusion. By the Supreme Court’s decision the case was dismissed from the district court, as it was believed that the material treatment and conviction in the case would violate Article 4(1) of the 7th Convention Annex to the European Convention on Human Rights, see Law No. 62/1994, on the right not to be prosecuted or punished twice.
Thirdly, a sentence was handed down in another case which had also been re-arrested by the Re-Entry Court. The Supreme Court confirmed the decision of the District Court to convict the accused but he was not given a sentence in the case because he had already served two years in prison on the basis of the previous decision of the Supreme Court.
