The Court of Justice in Case No. 74/2012

Today, the Supreme Court ruled in a case regarding the reopening of the court’s judgment in case No. 74/2012, where J and T had been convicted of major violations against tax law, which they committed in their own name and as the directors of B hf. The reopening court, by ruling on 21 January 2022, accepted the request of J and T for the reopening of the case in that regard.

The Supreme Court’s decision stated that in light of the facts and in the light of the Supreme Court’s decisions, the case was dismissed from the district court regarding criminal charges under Chapters I and II of the charge because of their personal tax returns. In the case both the prosecution and the defendant had made a claim to this effect. The parties’ disagreement led to the decision of the sentence for Chapters 1 and 2 of the charge because of violations that were committed in the operation of B hf. The Supreme Court’s decision stated that in the light of the violations of J under Chapter III of the charge and taking into account the case law, his violations were considered to be major and redirected to Article 262(1) of the General Penal Code No. 19/1940 and Article 30(2) of Act No. 45/1987. T was considered to have violated Article 30(2) of Act No. 45/1987. In the light of the significant delay that had occurred in the investigation of the case and its handling before the court at the earlier stages and taking into account the fines that J and T had already made, they were not given a special penalty in the case.
