Why does a prenuptial agreement need to be registered with the district commissioner?
Because a prenuptial agreement is only valid if it is formally registered with the district commissioner. Married couples or those intending to marry must register it in the district where they have their legal residence. If they do not have a legal residence in Iceland, the prenuptial agreement must be registered with the District Commissioner of Greater Reykjavík.
The District Commissioner of West Iceland maintains a national registry of prenuptial agreements dating back to 2008 and can provide information to the relevant parties about the agreements they have made. They are also responsible for publishing a notice of the registration of prenuptial agreements in the Official Gazette. This notice includes the names of the parties, identification numbers, legal residences, and the registration date.
