EDPB report on the Law Enforcement Directive and new recommendations on Binding Corporate Rules for Processors.

The European Data Protection Board (EDPB) has issued a report in support of the upcoming evaluation by the European Commission of the Law Enforcement Directive (LED). The Council also adopted recommendations on Processor Binding Corporate Rules (CR-P). In addition, the Digital Omnibus proposal was discussed, on which the EDPB is expected to deliver its opinion in February.

The report highlights the key role of the Directive in protecting personal data in law enforcement. The EDPB specifically notes that the boundaries between data protection law and the Law Enforcement Directive can be blurred and stresses that law enforcement authorities should ensure that the use of new technologies complies with the requirements of data protection law. Cooperation between data protection and law enforcement authorities is therefore particularly important and should be strengthened. In order to meet the requirements of both legislations, additional financial and human resources are needed to carry out the new tasks that come with new legislations, such as the new Entry Exit system.

The BCR-P Recommendation is an update of the existing Recommendation that contains criteria for the approval of BCR-Ps and combines them with a standard application form for BCR-Ps. The new Recommendation is based on the experience of data protection authorities in recent years. The Recommendation provides clear criteria and explanations so that it is possible to ensure that BCR-Ps are in line with data protection legislation. The Recommendation will be subject to public consultation until 2 March.
