In order for the District Commissioner to issue a divorce license or to certify for the end of cohabitation, parents must determine how their children's custody will be settled.

An agreement on custody

In the event of an agreement between parents on custody and other aspects to be agreed upon in the event of separation and cohabitation, the District Commissioner shall issue a licence to divorce or confirm the parents' agreement on custody, domicile and cohabitation.

Controversy over custody

In the event of a dispute regarding the custody of children in the event of divorce or separation, the district commissioner shall refer the matter to a mediator.

If conciliation is unsuccessful, a certificate of conciliation is issued, but the parent may apply to the courts for legal action for custody and, as the case may be, divorce, within 6 months of the issue of the certificate of settlement.
